    Lessons from Virginia Tech: The Changing Landscape in Higher Education

    Description:
    As we approach the one year anniversary of the tragedy at Virginia Tech, the Governor's Report, the President's Report and pending litigation are already impacting the way college administrators and faculty do their everyday work. With proposed legislation and examination in several states returning to the forefront on issues such as weapons on campus, FERPA, HIPPA, other confidentiality issues, mental (and physical) health services, student conduct and housing response and capabilities and inter- (and perhaps intra-) campus communication, it is imperative that student affairs and faculty administrators anticipate the changes in the landscape in order to help shape them. This class will examine these issues using topical journal and news articles, on-line discussion, and case law analysis.

    Students are encouraged to post stories and articles from their respective states and jurisdictions regarding the week's topic.

    This 3 week class will run over the course of one full month, to accommodate the 2008 ASJA conference. For those able to attend, the course will include an in person meeting at the ASJA Annual Conference for additional cumulative discussion.

    Course Outline:

    • WEEK ONE: The Federal Legislative Aftermath - The Future of FERPA, HIPPA and Inter and Intra campus confidentiality
    • WEEK TWO: The State Legislative Aftermath - Weapons on campus, arming the faculty and other pending legislation
    • WEEK THREE: The Procedural Aftermath - Dealing with Students in Crisis: A Procedural Standpoint Analysis; and The Future Aftermath - A Look to the "Future Student"

    Learning Outcomes:
    Upon completion of this course, participants will be able to:

    • Better understand how FERPA and HIPPA impact day to day operations at a college and university after the Virginia Tech tragedy
    • Anticipate and understand how to impact state legislation proposed in light of any recent event
    • Better understand and interpret FERPA and HIPPA
    • Better understand how case settlements and decisions can impact policy and protocol
    • Analyze the impact an event like the Virginia Tech tragedy impacts the immediate future in higher education
    • Understand the importance of a designed protocol (and how to begin to implement one) for dealing with students in distress

    Participant Expectations:
    Participants should plan to spend approximately 3 to 4 hours per week in this course. This will include time to read materials, complete on-line exercises and surveys and participate in asynchronous on-line discussions. Participants will need to log on for course content that will be posted weekly. In addition participants will need to respond to questions posted on the discussion board each week. As the discussion board is asynchronous, students may check in and post at their convenience. This learning tool will be an important part of participant's learning experience. Participants in the course attending ASJA 2008 will be invited to attend an in person discussion on the annual conference.

    Instructor Bio:
    W. Scott Lewis, JD is the Assistant Vice Provost at the University of South Carolina and serves on the Board of Directors for ASJA. He received his law degree from the University of Houston, and has been a faculty member, administrator, and consultant in higher education for over fifteen years. He presents regularly throughout the country on legal, judicial, risk management and administrative issues in higher education, as well as policy development and implementation. He has served as a co-author and editor in a number of areas. He has been a keynote and plenary speakers for a number of associations and on several campuses. Most recently, his work on Behavioral Intervention for students in crisis and distress has garnered national attention. He is also a member of NASPA, ACPA, and serves on the Board for SCCPA.
